Port mirroring legacy using Uplink as destination interface

Hi,  would to implement the following scenario:

each ESXI host we have is connected to a switch, the switch is connected to a physical sniffing tool

we have a DVS with several different port groups with different vlan tags

we would like the physical sniffing tool to be able to receive all mirrored traffic from the DVS (including layer 2 information such as vlan tags)

we were thinking of creating a legacy port mirroring session and providing the destination mirror as an Uplink in DVS

we than would connected this up link to the switch

My questions is as follows:

we have DRS in place, i've read in the Vsphere documentation that port mirroring legacy does not support vmotion

but that is only for non up link port groups,

what happens in uplink portgroups? when a vm migrates to a different host will the mirroring session still be replicated to the vmnic on the uplink of that host?
