upgrade esx 3.5 to 4 how to?

I wanted to get vsphere 4 on the servers that run esxi 3.5 and have a few vms on them.

How do I do it, there seems no upgrade option without loosing my vms.

Please assist. Also if vSphere 4 is free why does it say "evaluation" and where do I get the free license key from?

here's a good upgrade guide as well, if your not running vCenter.

...as for licensing I answered your question in the other thread you opened.
