Can't find the Virtual Appliance Marketplace anymore ???? - so I ask here ...
Is it legal to create a ESXi appliance and distribute it ?
Of course the VM would be license-less.
I need a small ESXi VM for LiveCD-usage - I already created one ripped down to the bare essentials - it is about 45 MB large now.
For LiveCD or other demo-use you do not need vmware-viclient.exe and all the isos embedded.

Not being an attorney I can only give what I think the answer will be... and that would be no. However, read the EULA carefully you may be able to do so. But my reading of it says it is not possible without permission from VMware.

Hello continuum. Further to what Texiwill said sometime in the last few weeks someone asked if they could package VMware Server with something they were releasing. The reply from a VMware employee was that you could not even though it was licensed for free. I tried to find the thread for you but the sites search function is not working currently... surprise surpriseX-( . Anyways I am not sure if it applies here or not. However, I think it is a similar situation.
If/when search starts working for me i'll update this thread with the link for you.
BTW keep up the good work your doing with MOA.

That is correct, there is no provision in the current EULA for ESXi (of any variety) to allow for end-consumer redistribution.
We're still ironing out what is required to get redistribution implemented in a scalable manner.

That sounds pretty complicated - JMills - do you know anyone at VMware that I could directly contact via email to talk about redistribution of some files ... ?

Ulli -- Quite likely yes. Drop me an email (my userid at VMware.com) with a description of what files you'd like to redistribute and I'll hunt down the appropriate person.
Just to pipe in as MOA user... If it helps Ulli's case in any way, whatever his plans for an ESXi package is, I am sure it is a noble cause and will be extremely useful to the community.
