Is it better to migrate from 5.5 to 6.5 or do a clean install of 6.5 and manually install the settings
Personally I think it depends on the size and complexity of your environment.
If it's a small environment, without a lot of DRS rules, plugins, vRealize components, Distributed switches, granular permissions etc then I'd recommend a clean install and migration is worth considering as it gives you the option to start with a clean slate.
However, if you have anything larger or more complicated then upgrade- it's normally a reasonably straightforward process and VMware and the community have created a lot of documentation to take you through it.

Unfortunately we are on the small side but the complicated side, we have most if not all of those items, VDS rules , DRS rules , permissions, HA, vmturbo etc. We are also on a windows 2008 hardware box. But your right i have come across some really good documentation on the community I believe will help. So is it considered an upgrade to go from hardware to a virtual appliance.

Upgrade - upgrade an existing appliance
Migrate - Migrate from an existing vCenter for Windows to a vCenter server appliance)
Sounds like I should choose migrate, that describes exactly what I am doing
Isn't upgrade based on if you already have an appliance in place? We are going from a windows installation of 5.5 to an appliance. Based on the installation description it seems like the option would be migrate

If you're going from a Windows vCenter to the vCSA, then the path would be "Migration" in the vCSA Wizard.
