esx3i licensing question

also currently asking vmware sales this question so appologies if this is not the correct place to post this.

If we have customers that want to consolodate there applications, As we don't require clustering etc...are we able to sell a single hardware server solution to run on the customers site and then run the free ESX3i solution on it then license the VM's. We are aware that there is vmware support options for ESX3i which we would purchase probably on a per incident but is there some EULA for ESX3i that prohibits this?

Short form, redistribution of ESXi is on an agreement-basis only, i.e. you must have a specific contractual agreement in order to be able to do so.

I have a vested interest in VA related ESXi proliferation, of course.
