The Patch portal you mentioned does not provide upgrade packages, these have to be downloaded from the Download Center.
For supported upgrade methods, see http://kb.vmware.com/kb/1022140

I've download upgrade-from-esxi4.0-to-4.1-update03-800380.zip and now I'll try to do an upgrade.
You didn't have the time to read the second link I posts, did you

Thx again I'll try, but howto check if hardware is supported?
I have DELL PowerEdge 1950 server.
You can search for your specific system in the VMware Compatibility Guide to see which ESXi versions are supported.

You have to upgrade your license from Myvmware Portal.
Generally any licese, which are under support contract, you should be able to upgrade .
this KB article should be helpful how to get the new license : kb.vmware.com/kb/2006974
I've put ESX into maintenance mode and now I try to upgrade, but get this error message:

What's wrong and howto solve this problem?
It looks like you are trying to install the upgrade bundle for ESXi rather than for ESX. Please download the correct bundle for the classic ESX edition.

Sorry my fault, it works well now.
