The only version where you don´t need a licence is the free version of te ESXi hypervisor. All other version (from standard till enterprise plus) requieres a valid licence.

Depending on your requirements you can get different licenses for the editions offered by VMware. Please take a look at http://www.vmware.com/files/pdf/vsphere_pricing.pdf for licensing and the features.

You ALWAYS need a license but I think the question is whether or not you have to also have to pay to use the software.
The free hypervisor has the following restrictions:
You may only install and use vSphere Hypervisor on a Server that has up to 32GB of physical RAM and the vRAM entitlement for each Server is limited to 32 gigabytes.

You always will need a license key, even if you're using the free Hypervisor, ESXi.
vCenter Server is NOT a free product will require a paid license key.
Basically, to summarize, the only product that is free is the base hypervisor and as mentioned above, there are limitations; although depending on your project, those limitations may not be a concern.
