As per VMware Product Lifecycle http://vmware.com/go/lifecycle vSphere 4.x is End of Support and will be End of Technical Guidance on 2016.

I would recommend to upgrade to 5.5 since 5.0/5.1 will also be End of Support on 2016.

Thanks, Do EOC declared products make invalid the license as well?

The license will not expire, it's just a matter of getting support in case you need it.
